Majek Fashek Sues Timi Dakolo Over Song Theft, Demands Ridiculous Amount As Compensation

In 2016, West African Idol winner and songwriter, Timi Dakolo was accused by legendary Reggae musician Majek Fashek, for stealing his song.

The management of the veteran singer has taken the matter to court and is suing Timi Dakolo for N100m over copyright infringement of the song ‘Send Down the Rain’.

Timi Dakolo on his part said there was no case against him as he went through the copyright permission process before doing his version of the song, which was released in 2012. He claims to have contacted Charles Novia who acted on behalf of Majek Fashek at the time.

AlthoughTimi Dakolo did Justice to the song, he got several criticisms from Nigerians, including Majek Fashek who called him a thief.

According to reports, Timi only released the song online but has never performed it publicly alone, thus have not earned any money from it.

The only exception was when Majek and Dakolo were joined by South Africa-based jazz act, Kunle Kuti at the 2015 Headies to perform ‘Send Down The Rain’.

Unfortunately for ‘the Vow’ singer,  his claim of paying for permissions to use the song is being over-ridden since Majek’s manager, Uzoma Omenka has insisted on suing.

Uzoma Omenka said:

“We are not taking this case lightly. We are just awaiting the arrival of our solicitors from the U.S., and the UK then we will hit the courts.

“For crying out loud, this guy is making money from itunes and he did what he did because he thinks in Nigeria, anything goes.

“If he can prove as he claimed that he paid for the use of the song and he can show concrete proof of it then he will go free, but if not, we will definitely meet in court.”

Meanwhile, prior to the death of gospel singer, Eric Arubayi, who is a friend to Timi and was a co-contestant at the West African Idol, Timi was planning to release a single, ‘Medicine’.

The song featured his children whom he refers as Yard people and was produced by ace melody maker, Cobhams Asuqwo. In memory of Eric, Timi had to postpone the release of Miracle, explaining why in a Facebook post.

He wrote:

“I AM REALLY SORRY GUYS… I HAVE TO CHILL ON THE RELEASE OF THIS SONG(MEDICINE).. PAPA JAYDEN (ERIC ARUBAYI) HAS HURRIED TO HEAVEN AND I HAVE RESPECT THAT… THANK YOU FOR UNDERSTANDING.”

In a series of posts, Timi Dakolo expressed his hurt over the death of his dear colleague and friend, Eric.

He wrote:

“IT HURTS..IT HURTS DEEPLY.. .MY HEART HAS REFUSE TO ACCEPT THIS… MY MIND HOLDS SO MUCH MEMORIES.. OUR BOYS ROOM IN THE IDOL HOUSE.. HOW TO DRESS LECTURES. ..YABBINGS.. MAKANAKI(ERIC) HOW WE UNDERSTOOD EACH OTHER.. ONE LOOK AND I KNEW THERE WAS GIST.. IT HURTS I SWEAR..

“I HAVE REASONED WHY ALL NIGHT AND LOGIC HAS FAILED ME.. I CAN SEE ANYTHING GOOD ABOUT THIS BYE.. I WONT LIE… SO I WONT SAY GOODBYE..I WOULD BE STILL AND LET GOD BE GOD.. .YOU ARE GREAT FATHER AND FRIEND TO US ALL ..SO I WILL HAVE PLENTY STORIES TO TELL JAYDEN CONCERNING HIS FATHER… AND NONSO ABOUT HER HANDSOME HUSBAND.. However, Timi Dakolo eventually dropped Medicine today, 14th February and it’s a nice jam to listen to.
